Abstract

The aim of this study is to understand the institute of the non-requirability of different conduct, as an exculpatory defense, and its application by the justice system institutions. Using the methodology of a bibliographical and brazilian´s jurisprudential review, the research is justified by the serious economic crisis the country is undergoing and the state’s greed for revenue, seeking more tax income in every way. This study is concerned with establishing the non-requirability of different conduct as a means of containing criminal law so that it does not become a mere tax collector.
